Throughout the site, the terms “we”, “us” and “our” refer to AmplifyME. We offer the following website [www.amplifyme.com] and all its subdomains (e.g. portal.amplifyme.com) (the “Platforms”) including all information, tools and services available from these sites to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and Platforms and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, eligible users, vendors, customers, merchants, and/ or contributors of content.

Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the websites through which the service is provided, without express written permission by us.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

3.      ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

While we maintain high information standards, we are not responsible if information made available on our sites and Platforms is not accurate, complete or current. The material on our sites and Platforms is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on the sites is at your own risk.

The sites may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of our site and Platforms at any time, but we have no obligation to update any information on our site or Platforms. We aim to keep our customers informed of service and price changes, however prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice.

We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

The copyright in all material contained on our site and Platforms, including all information, data, text, images, and all source code and other software is owned by AmplifyME or our licensors (“Content”). All rights are reserved. You can view and download the Content for your own personal use, but you cannot otherwise copy, edit, vary, reproduce, publish, display, distribute, store, transmit, commercially exploit, disseminate in any form whatsoever or use the Content without our permission.

5.      AVAILABILITY

AmplifyME will use reasonable endeavours to make our site and Platforms available to you at all times. However, there may be occasions when access to the site and Platforms may be interrupted, including for scheduled maintenance or upgrades, for emergency repairs, or due to failure of telecommunications links and/or equipment. In addition, you acknowledge that the Internet may be subject to breaches of security and that the submission of content and interactions with other users may not be secure.

AmplifyME reserves the right to remove any content or features from our site or Platforms for any reason, without prior notice and/or to suspend or cease providing any services relating to the site or Platforms without notice and shall have no liability or responsibility to you in any manner whatsoever in such circumstances, save to refund any fees paid in advance in respect of any period when the site or Platforms have been suspended or stopped.

6.      OPTIONAL TOOLS

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.

You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

Any use by you of optional tools offered through the sites is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

We may also, in the future, offer new services and/or features through the websites (including, the release of new tools and resources). Such new features and/or services shall also be subject to these Terms of Service.

7.      LINKS TO THIRD PARTY CONTENT

The site or Platforms may contain links to websites or Sites operated by third parties. AmplifyME does not have any influence or control over any such third-party websites or Sites and AmplifyME are not responsible for and do not endorse any third-party websites or Sites or their availability or content.

AmplifyME accept no responsibility for adverts contained within our site or Platforms. If you agree to purchase goods and/or services from any third party who advertises in the site or Platforms, you do so at your own risk. The advertiser, and not us, is responsible for such goods and/or services and if you have any questions or complaints in relation to them, you should contact the advertiser.

8.      SERVICES AND PLATFORMS

We reserve the right, but are not obligated, to limit the usage or sales of our Platforms or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any services that we offer. All descriptions or pricing of our Platforms and Services are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any Platform or Service at any time. Any offer for any Platform or Service made on this site is void where prohibited.

We always aim to exceed customer expectations but do not warrant that the quality of any Platforms, Services or content therein obtained by you will meet expectations beyond our stated descriptions. We aim to correct errors in the Platforms or Services in an appropriate manner. Reported errors in printed publications will be fixed in future revisions but we do not offer fixes for existing editions.

8.1.      Platform Registration

You warrant that all information that you provide to us on sign up or registration is accurate and complete and it is your obligation to make any necessary changes to that information within your account.

You are responsible for maintaining the confidentiality of your account. Please take precautions to protect your account details and to change your password or contact us immediately to request a change to your password if you believe there has been any unauthorised use of your account.

Your submission of personal information through our site and Platforms is governed by our PRIVACY POLICY.

8.2.      Use of the Site and Platforms

Our site, Platforms and Services are made available for your own, personal use. The site and Platforms must not be used for any illegal or unauthorised purpose.

When you use our site, Platforms and Services you must comply with all applicable laws. In particular, but without limitation, you must not try to gain unauthorised access to the Platforms or any networks, servers or computer systems connected to the Platforms and/or reproduce, redistribute, sell, create derivative works from, decompile, reverse engineer, or disassemble all or part of the site or Platforms save to the extent expressly permitted by law.

When you use our site, Platforms and Services you must comply with our ACCEPTABLE USE POLICY at all times. AmplifyME reserves the right to remove a participant from any of our Platforms at any time if they are in breach of this Policy.

8.3.      Performance Metrics

By using our Platforms and Services, and interacting with our content and participating in our simulations therein, you agree for us to capture data related to your level of engagement with our content and Platforms and measure your level of simulation performance using our own bespoke and third party metrics. This enables us to provide performance reports for you to review how well you performed in our simulations.

The performance reports are designed to help you better understand your strengths and weaknesses in the simulated roles you are performing so that you can make more informed decisions as to the optimum career path for you. The performance metrics are measured using our own proprietary technology and you agree that your post simulation performance results are solely determined by the AmplifyME Platform and are final and non-adjustable. If you wish to improve your performance metrics then the best way is to reflect on your initial performance, consume more of our content related to that role to better understand it and then, where possible, retake the simulation.

8.4.      Simulations and Recruitment Referral Services

The content and the simulation experiences offered on our site and Platforms (e.g. our Finance Accelerator simulations, our career and university pathways platform, our Summer Analyst Training Programme and our general simulation events we deliver for university and corporate clients) are designed to replicate roles in the finance industry as closely as possible. Whilst we endeavour to update our content and simulations as often as we can, we do not guarantee, represent or warrant that any content or simulation is a true and accurate representation of any specific role in today's finance industry.

AmplifyME reserves the right to amend, alter or terminate our simulation events at any time due to circumstances beyond our control.

By interacting with our content and participating in our simulations, you agree to AmplifyME sharing your data with sponsors as outlined in our PRIVACY POLICY. This data will only be used in cases of legitimate interest, such as connecting you with our financial institution partners in relation to job opportunities with that firm.

Our mission as a business is to democratise job opportunities in finance and to help people obtain jobs by proving their potential ability to perform a role. We endeavour to upskill you by providing our content and simulations with the aim of helping you enhance your job candidate profile to generally improve your chances of obtaining the jobs you aspire to. However, utilising our Platform and Services in no way entitles you to any job opportunities. Furthermore, AmplifyME does not guarantee, represent or warrant that using any of our Platforms or Services will result in you obtaining a job. The decision on who AmplifyME selects to be recommended for roles at our partner financial institutions is made by AmplifyME based on eligibility criteria set by the financial institution and on the engagement and performance data captured by AmplifyME when you are engaging with our Platform and Services. AmplifyME’s decision on who to recommend for roles at our partner financial institutions is final. No correspondence will be entered into.

8.5.      University Pathways

Certain parts of our site and Platforms are available to access and download only if you are defined as an Eligible User as part of your University entering into a University Pathways Licensing Agreement with AmplifyME that gives you access to certain premium content.

Each Eligible User license is for a single user only and your login details or any downloadable content are not to be shared or accessed by multiple people. You are responsible for keeping your login credentials confidential. All content accessed through AmplifyME’s Platforms and Services is for your personal and non-commercial use. Violations of this policy may result in immediate termination of your account.

8.6.      Platforms and Services Paid for by the Individual

Some of our Platforms and Services are offered to individuals for a fee (e.g. our Summer Analyst Training Programme). For all such products our PAYMENTS & REFUNDS POLICY applies

9.      USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS

If, at our request, you send certain specific submissions (for example uploaded files as part of a simulation activity) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, ‘comments’), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence*; (2) to pay compensation for any comments; or (3) to respond to any comments.

10.  DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

While we go to great lengths to ensure the security and reliability of our site, Platforms and Services we do not guarantee, represent or warrant that your use of our site, Platforms and Services will be uninterrupted, timely, secure or error-free.

You agree that from time to time we may remove the site, Platforms or Services for indefinite periods of time. We will take appropriate measures to inform our users of any downtime or if a Service will cease to exist.

You expressly agree that your use of, or inability to use, the site, Platforms or Services is at your sole risk. The site, Platforms or Services are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

In no case shall AmplifyME, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of employment, loss of employment opportunities, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of our Platforms or Services or any products procured using the service, or for any other claim related in any way to your use of the site, Platforms or Services or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the site, Platforms or Services or any content (or product) posted, transmitted, or otherwise made available via the site, Platforms or Services, even if advised of their possibility. Because some jurisdictions or states do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such jurisdictions or states, our liability shall be limited to the maximum extent permitted by law.

AmplifyME shall prepare the content on our site and Platforms with reasonable skill and care. However, AmplifyME does not warrant that any result will be achieved or achievable by you through viewing the site’s or Platforms’ content.

Information or opinions provided by AmplifyME or any third-party user of the site or Platforms should not be used for investment advice and do not constitute an offer to sell or solicitation of an offer to buy any securities or financial instruments or any advice or recommendation with respect to such securities or other financial instruments.

Content and associated material on the site and Platforms does not constitute a personal recommendation or take into account the particular investment objectives, financial situations, or needs of individual clients. You agree to indemnify, defend and hold harmless AmplifyME, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

12.  SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

13.  TERMINATION

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our site, Platforms or Services, or when you cease using our site, Platforms or Services.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Platforms or Services (or any part thereof).

14.  ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to Platforms or Services constitutes the entire agreement and understanding between you and us and govern your use of the site, Platforms and Services, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

15.  GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the United Kingdom.
